I, CHARLES ALEXANDER DICK-MELBOURNE of

"Tanderagee" No. 132, The Peak in the Colony of Hong Kong, Barrister-at-Law, do solemnly and sincerely declare and say as follows:-

(1) I am a member of the Inner Temple, London, England, and was called to the English Bar on the 17th

day of November 1891. I was admitted to practise as a Barrister in the Supreme Court of Hongkong on the 14th

day of November,1895.

(2) On the 1st day of May 1900 I entered the service of the Hongkong Government by whom I am still employed and at the present time occupy the position of Deputy Registrar and Appraiser in the Supreme Court

of Hongkong.

(3) Mrs. Kirch is my sister. I knew and was

well acquainted with her husband, Mr. H.H.Kirch, who, with Mrs. Kirch, resided in the said Colony of Hongkong from the year 1894 up to the 27th day of April, 1899.

(4) Mr.H.H.Kirch was for some time prior to the

year 1893 a partner in the firm of Schelhass and Co. which carried on business in Hongkong as General Merchants but in or about the year 1898 Mr.H.H.Kirch

left the firm of Schelhass and Co. and started business

on his own account as a General Merchant under the

style of "H.H.Kirch and Co". Mr.H.H.Kirch was in financial difficulties during and for some time prior to the month of April 1899 and to my knowledge he was

in consequence much pressed by his creditors for

payment of various large amounts due to such creditors.
